Through the use of www.tailorjoy.com and the purchase of our products and services, you are therefore consenting to the terms and conditions expressed in this Policy. 

Scope of Terms

Tailor Joy LLC is the owner of this Site www.tailorjoy.com, (referred to as the “Site”). The Site and services and products offered may include, but are not limited to, articles, reference and communication tools, message boards, books, resources, courses, tutoring, coaching, and information products (the “Service”). The Service is owned and operated by Jennifer Donaldson, Tailor Joy LLC (“us,” “our,” and “we”).

Access to all areas of the Site is provided in accordance with the following terms (“Terms”). By using the Site, you electronically agree to be legally bound by the Terms, which govern your use of the Site. If you do not agree to all of these Terms, please immediately discontinue any further use of the Site. Your failure to follow the Terms may result in suspension or termination of your access to the Site.

The Site was developed strictly for informational purposes. You understand and agree that you are fully responsible for your use of the information provided on the Site. Tailor Joy LLC makes no representations, warranties, or guarantees. You understand that results may vary from person to person. Tailor Joy LLC assumes no responsibility for errors or omissions that may appear in the Site.

We may change these Terms at any time. Continued access to the Site by you will constitute your acceptance of any changes or revisions to the Terms.

General Usage Rules

We reserve the right to refuse service to anyone for any reason at any time. You agree not to disrupt, modify or interfere with the Site, or its associated software, hardware, and/or servers in any way, and you agree not to impede or interfere with others’ use of the Site. You also agree not to alter or tamper with any information or materials on or associated with the Site.

Passwords

Your right to use the Site is personal to you. You may not sub-license, transfer, sell or assign your right to access or use the Site to any third party without prior our written approval. Any attempt to do so will be null and void and will be considered a material breach of the Terms.

You will be solely responsible for maintaining the confidentiality of your password. You are solely responsible for all usage or activity on your account including, but not limited to, use of the account by any person who uses your ID and password. If you have reason to believe that your account is no longer secure (for example, in the event of a loss, theft, or unauthorized disclosure or use of your ID, password or any credit, debit or charge card number stored on the Site), you must promptly change your password and notify us by contacting us by email at hello@www.tailorjoy.com.

Proprietary Rights

You acknowledge and agree that the Site and the information, content and software presented to you through or by the Site or used in connection with the Site contain proprietary and confidential information that is protected by applicable intellectual property rights and other laws, including those pertaining to the protection of copyrights, trademarks, service marks, and patents, and security components that protect digital information. Except as expressly authorized by us, you agree not to sell, rewrite, modify, redistribute, create derivative works, or rent any part of the Site or any information presented to you through the Site, in whole or in part.

You may not remove any copyright notices from our materials. We reserve all of our other rights not granted in these Terms. You agree not to access the Site by any means other than through the interface that is provided by us for use in accessing the Site.

License

We grant you a personal, non-exclusive, non-transferable, limited and revocable license to use the Site and the Service subject to these Terms. You may not use the Site in a manner that exceeds the rights granted for your use of the Site, which includes unauthorized copying or distribution of any of the content displayed or used in the Site or creating an unauthorized derivative work.

Information Provided by You

If you upload materials, content or information (collectively, “Information”) to areas of the Site that are available to other users, you give us an irrevocable, perpetual license to use, reproduce, modify, adapt, publicly perform and publicly display the Information. Please refer to our Privacy Policy for an explanation of how we use your information and your rights to change or delete it.

Restrictions Applicable to Use

Product Purchase

By purchasing products from Tailor Joy LLC, you are agreeing that the contents are the property of Jennifer Donaldson/Tailor Joy LLC and licensed to you as a single user for personal use. This product and its contents may not be modified, sold, or displayed on the internet. Please purchase additional copies if you wish to share with friends, or share the Tailor Joy  website so they can purchase their own.

If you have purchased a digital download product, due to the nature of the product, we do not offer refunds, exchanges, or cancellations. Please contact the Tailor Joy LLC about any problems with your order. 

If you have purchased a special order printing, due to the print on demand order, we cannot offer refunds or cancellations. Please contact Tailor Joy LLC about any problems with your order. 

YOU CAN:

Use free and purchased items for your own personal use. You may reference this product ONLY if both credit is given to Jennifer Donaldson as the author AND a link back to the Tailor Joy website is included. 

YOU CANNOT:

Notice and Take Down Procedures and Copyright Agent

If you believe any materials accessible on or from the Site infringe your copyright, trademark or other legal rights, you may request removal of those materials (or access thereto) from the Site by contacting us at hello@www.tailorjoy.com.

Termination and Modification

You agree that we may without prior notice, discontinue, temporarily or permanently, the Site (or any part thereof) or eliminate your account, any associated email address, and remove any information you uploaded or provided to the Site with or without notice. Cause for termination will include, but not be limited to, (a) violations of these Terms or or any other policy of Tailor Joy LLC, (b) requests by law enforcement or other government agencies, (c) a request by you (d) discontinuance or material modification to the Site, or (e) unexpected technical or security issues or problems.

Entire Agreement

These Terms and the policies, rules and guidelines posted on the Site constitute the entire contract between you and us and supersede all previous written or oral contracts. If any part of the Terms is held invalid or unenforceable, that portion will be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions will remain in full force and effect.

Choice of Law and Place for Resolving Disputes

It is at the mutual agreement of both you and Jennifer Donaldson, Tailor Joy LLC with regard to the Terms that the relationship between the parties shall be governed by the laws of the state of North Carolina without regard to its conflict of law provisions and that any and all claims, causes of action and/or disputes, arising out of or relating to the Terms, or the relationship between you and Jennifer Donaldson, Tailor Joy LLC, shall be filed within the courts having jurisdiction within the County of Wake, North Carolina or the U.S. District Court located in said state. You and Jennifer Donaldson, Tailor Joy LLC agree to submit to the jurisdiction of the courts as previously mentioned, and agree to waive any and all objections to the exercise of jurisdiction over the parties by such courts and to venue in such courts. 

Statute of Limitations

You acknowledge, understand and agree that regardless of any statute or law to the contrary, any claim or action arising out of or related to the use of our Services or the Terms must be filed within 3 year(s) after said claim or cause of action arose or shall be forever barred.

Assignments

We may assign this contract at any time without notice to you. You may not assign this contract to anyone else.

Execution of Agreement

Your continued use of the Site constitutes your acceptance of these Terms as a legal contract and the equivalent of an electronic signature. Natural persons executing this contract warrant and represent that they are at least eighteen (18) years of age. Users and the person executing this Agreement on behalf of any user that is a proprietorship, corporation, partnership or other entity, represent that such Person is duly authorized by all necessary and appropriate corporate or other action to execute this contract on behalf of the user.

No Right of Survivorship Non-Transferability 

You acknowledge, understand and agree that your account is non-transferable and any rights to your ID and/or contents within your account shall terminate upon your death. Upon receipt of a copy of a death certificate, your account may be terminated and all contents therein permanently deleted.

Terms and Conditions: Tutoring and Coaching Services

Please read the Terms carefully before making a payment as these terms and conditions will guide your purchase of, payment, and refund for sessions scheduled and shall also determine your right with regard to a refund, including essential restrictions and exclusions. 

Through the use of www.tailorjoy.com and the purchase of our products and services, you are therefore consenting to the terms and conditions expressed in this Policy. 

Scope of Terms

The Service is owned and operated by Jennifer Donaldson, Tailor Joy LLC (“us,” “our,” and “we”).

Access to the Service (“Service” and “Session”) is provided in accordance with the following terms and conditions (“Terms”). By paying for Sessions, you, the Client (“Client”), electronically agree to be legally bound by the Terms, which govern your use of the tutoring and coaching Services. If you do not agree to all of these Terms, please immediately discontinue any further use of the Service. Your failure to follow the Terms may result in termination of services.

We may change these Terms at any time. Continued access to the Service by you will constitute your acceptance of any changes or revisions to the Terms.

Payment

The Client agrees to pay Tailor Joy LLC the agreed upon package or session rate for tutoring or coaching services. The Client understands that this is prepayment for the monthly or package tutoring or coaching services charged by the session. Invoices will be sent through email a minimum of 10 days prior to the payment due date. Payment for scheduled sessions for that month is due by the 10th of the month. A late fee of $25 may be applied for failure to pay by the 10th unless otherwise prearranged. Payment may be by cash, credit card, or bank payments. 

Cancellation

Tailor Joy LLC is flexible for illness, holidays, or schedule conflicts and sessions can be rescheduled for an alternate date if the Client provided a minimum of 24 hours notice of cancellation. If the Client cancels a session with less than 24 hours notice, the Client will be billed for the session. Emergency cancellations up to one hour before the scheduled session due to family emergency or sickness will have the session payment applied to a future session. Failure to show up for a session within 15 minutes of the start time (in person or online) without giving notice will be charged at the full session rate. If the tutor or coach cancels for any reason at any time more than 24 hours prior to a session, the full session payment will be applied to a future session. 

Location

The tutor or coach may host online sessions via Zoom or other video conferencing platform or the tutor or coach may offer sessions in person at an agreed upon location. 

Session Schedule

Sessions are arranged subject to availability of the tutor or coach. Sessions will be scheduled through a scheduling tool/app using the Eastern Standard/Daylight Time (EST). It is the Client’s responsibility to make sure the schedule, time zone, and location are accurate. Unless otherwise arranged, all one on one tutoring and coaching sessions are 55 minutes in duration. Meet and greets, parent conferences, and some tutoring and coaching sessions are 25 minutes in duration and charged accordingly. 

No Guarantees or Warranties

The Client understands that Tailor Joy LLC does not guarantee any specific outcomes as a result of tutoring or coaching. Tailor Joy LLC will provide tutoring or coaching to help a Client succeed. The rest depends on the Client. Results vary from Client to Client.

Obligations of the Client

The Client will provide information to Tailor Joy LLC to assess and identify areas that need tutoring or coaching and provide adequate contact details including email and mobile number. The Client agrees to provide their own material for each session (computer, webcam, microphone, internet, pencil and paper, etc.). Tutoring clients in grades 3 – college are expected to use an agenda system (paper, book, or digital) on a daily basis to record homework, plan out projects and study time, and check off completed work unless they attend a “no homework policy” school. The Client will arrive on time to the scheduled session or provide 24 hours notice of cancellation. Abusive or discriminatory behavior towards tutors or coaches or other students will not be accepted. Tailor Joy LLC reserves the right to cancel any session for Clients whose behavior is unacceptable or where abusive language is used. 

Special Requests

Tailor Joy LLC reserves the right to charge for special requests. Examples include completion of form/questionnaire for educational psychologists or other educational professionals, a formal written report regarding student progress, attending a parent conference or educational meeting, emergency scheduled sessions, assigning homework over summer break if Client is not enrolled in summer sessions, or written feedback on work outside of Session times. Clients will be informed of charges for special requests before services are rendered.

Minors

Where the Client is a legal minor, the parent/guardian shall agree to the terms and conditions on behalf of the Client.

Data Protection

Tailor Joy LLC may hold and use Client data for the purposes of the services that it provides. Clients providing personal data to Tailor Joy LLC are consenting to the use of that data by Tailor Joy LLC for the purposes of tutoring or coaching services, for billing and collecting purposes and to enable Tailor Joy LLC to contact Clients. Where required for legitimate purposes in connection with Tailor Joy LLC business and subject to suitable safeguards that data may be transferred to others. 

Termination

Tutoring and coaching are offered on a month to month basis and may be terminated by either party with notice given by email within that month. Certain special promotions offer a package of tutoring or coaching and will be handled on an individual basis by email during that period but may not be eligible for refund if terminated.

Limitations of Liability

In event of litigation, Tailor Joy LLC’s total liability shall not exceed the amount of money the Client paid Tailor Joy LLC for services rendered. 

Cancellations and Refunds

Tailor Joy LLC reserves the right to charge the cost of a session if the Client fails to show up within 15 minutes of the start time or cancel without at least 24 hours notice to Tailor Joy LLC, and this shall be done without the possibility of a refund for the session. 

Clients can cancel or reschedule a session through the scheduling app or by sending a text or email to the tutor or coach with at least 24 hours notice. A canceled session, with 24 hours notice, will be credited for a scheduled session in the upcoming month. Tailor Joy LLC may cancel or reschedule a scheduled session in the event that the Client is defaulting on payment for the tutoring or coaching services.

Emergency cancellations due to family emergency or sickness may be emailed or texted up to an hour before the scheduled start time of a session by either the Client or the tutor or coach.

Clients shall be eligible for refunds on unused sessions within three months of purchase date. The refund may not be issued for sessions where the Client did not give 24 hours notice. Tailor Joy Tutoring is not responsible for any kind of fee charged by payment processors and will not cover it when initiating a refund. To the fullest extent permitted by law, any refunds at any time are at the sole discretion of Tailor Joy LLC only. 

Upon review of the Client’s refund request and the determination that a refund is due, Tailor Joy LLC shall issue a refund. Refunds may take several months to process back to the credit card used to pay and are subject to the terms and policies of the bank regarding the speed of transactions. 

In the event of a chargeback by a credit card company or payment processor in connection with a payment, the Client will be responsible for charges and Tailor Joy LLC may cancel or reschedule a scheduled session in the event that the Client is defaulting on payment. Disputes that require accounting or legal services shall be covered by the Client.

Note: Coaching package purchased with Business Basics Plus is not available for a refund but can be used within 3 months from the purchase date. 

Choice of Law and Place for Resolving Disputes
